The project management contract is concluded in writing, regardless of the amount involved, and sets out, on pain of nullity :
1° The work which is the subject of the contract, the responsibilities entrusted to the agent, the conditions under which the project owner declares the completion of the agent’s assignment, where applicable the terms of the agent’s remuneration, the penalties applicable to the agent in the event of failure to fulfil its obligations and the conditions under which the contract may be terminated;
2° The method of financing the work and the conditions under which the project owner will advance the funds required to perform the contract or reimburse the expenses incurred on its behalf and defined in advance;
3° The terms and conditions of the technical, financial and accounting control exercised by the project owner at the various stages of the project;
4° The conditions under which approval of the preliminary design studies and acceptance of the work are subject to the prior agreement of the project owner;
5° The conditions under which the agent may take legal action on behalf of the project owner.
