Article L243-7 of the French Insurance Code

The provisions of article L. 113-16 and of the second paragraph of article L. 121-10 of this Code do not apply to the compulsory insurance provided for in this Title.

Victims of loss or damage covered by law no. 78-12 of 4 January 1978 may take direct action against the insurer of the person responsible for such loss or damage if the latter is in receivership or liquidation.

Les dispositions de l’article L. 113-16 et du deuxième alinéa de l’article L. 121-10 du présent code ne sont pas applicables aux assurances obligatoires prévues par le présent titre.

Les victimes des dommages prévus par la loi n° 78-12 du 4 janvier 1978 ont la possibilité d’agir directement contre l’assureur du responsable desdits dommages si ce dernier est en règlement judiciaire ou en liquidation de biens.
