Housing allocated by the municipality or the City of Paris and located in the arrondissement is allocated half by the arrondissement mayor and half by the mayor of the municipality or by the mayor of Paris.
After consulting the arrondissement councils, the municipal council or the Paris council may draw up a list of priority rehousings giving rise to the allocation of housing by the mayor of the municipality or by the mayor of Paris. Priority is given to rehousing made necessary in the event of danger, disaster or catastrophe, by the implementation of an operation to reduce substandard housing, renovation, rehabilitation or demolition or by the implementation of any operation of a cultural nature or by transfers proposed by social landlords within the social housing stock.
Housing exempted by resolution of the municipal council or the Paris council from the application of the rule set out in the first paragraph may not, in each arrondissement, relate to more than 50% of the housing for which the allocation is the responsibility of the municipality or the City of Paris.
Housing allocated by the commune or the City of Paris and located outside the territory of the commune or the City of Paris is allocated by a municipal commission comprising, in equal numbers, representatives of the arrondissement mayors and representatives of the mayor of the commune or the mayor of Paris, appointed from among the elected councillors.
The first four paragraphs also apply to allocation decisions or proposals that are the responsibility of the municipality or the City of Paris for housing reserved for it by agreement.
A decree in the Council of State sets out the conditions for the application of this article.
