As an exception to the provisions of article L. 2223-17, on an exceptional basis, when a thirty-year, fifty-year, hundred-year or perpetual plot, granted before 11 November 1918 to persons who, on 22 January 1949, held German nationality and had left French territory, has ceased to be maintained, the mayor may record this state of neglect by means of a report made available to the public under the conditions laid down by the decree of the Conseil d’Etat provided for in article L. 2223-18.
When, in the six months following this publicity, there is no successor to the concession holder, the mayor has the right to order, by decree and with the assent of the municipal council, that the land allocated to these concessions be taken back by the municipality.
