CHAPTER II : Administration and municipal services

The provisions of Title I of Book II of this part are applicable to the communes of the départements of Moselle, Bas-Rhin and Haut-Rhin, with the exception of those of articles L. 2212-1, L. 2212-2, L. 2212-3, L. 2212-4, L. 2213-6, L. 2213-7, L. 2213-8, L. 2213-9, L. 2213-21, L. 2213-26, L. 2213-27, L. 2214-3, L. 2214-4,L. 2215-1 and L. 2215-4.

The mayor directs the local police. It is his responsibility to issue local police orders in accordance with existing laws.

The mayor’s own duties are to ensure that the inhabitants enjoy the benefits of good policing, in particular cleanliness, salubrity, safety and tranquillity in the streets, places and public buildings. It is also the mayor’s responsibility to ensure the tranquillity, salubrity and safety of the countryside.

Without prejudice to the powers of the representative of the State in the department by virtue of 9° of Article 2 of Section III of the Decree of 22 December 1789, the police matters entrusted to the vigilance and authority of the mayor are those determined in 1°, 3°, 4°, 6° and 7° of Article L. 2212-2. The most suitable method for transporting the bodies is regulated by the mayor depending on the locality.

At least once a year, the mayor must inspect or have inspected the fireplaces and chimneys of all buildings less than 200 metres from dwellings, after the day of the inspection has been made public at least one week in advance. After the inspection, the cleaning, repair or demolition of fireplaces and chimneys that do not comply with legal requirements may be ordered.

The mayor may prescribe: 1° To close or fill in quarries, clay pits, sand pits, ballast pits, marl pits, lime pits, clay pits, mine shafts, excavation holes or holes resulting from the uprooting of stumps; 2° To mark with visible signs, to prevent their approach, holes made in the ice in places indicated by the authority.

The mayor may issue orders: 1° When ordering local precautions on objects entrusted to his vigilance and authority by 1°, 3° and 4° of Article L. 2212-2, by the second, third and fourth paragraphs of article L. 2542-4 and by article L. 2542-5 ; 2° When it is a matter of republishing police laws and regulations or reminding citizens to observe them.

The conditions under which field wardens may be recruited are defined by the provisions of Chapter III of Title II of Book V of the Internal Security Code.

In communes where the State police force has been instituted, the mayor remains vested with the police powers conferred on municipal administrations by article L. 2542-2 for all matters relating to 1°, 2° for all matters relating to neighbourhood noise, 4°, 6° and 7° of article L. 2212-2 as well as: 1° The method of transporting deceased persons, burials and exhumations, the maintenance of good order and decency in cemeteries…
