Article L2542-27 of the French General Code of Local Authorities

As an exception to the provisions of article L. 2223-17, on an exceptional basis, when a thirty-year, fifty-year, hundred-year or perpetual plot, granted before 11 November 1918 to persons who, on 22 January 1949, held German nationality and had left French territory, has ceased to be maintained, the mayor may record this state of neglect by means of a report made available to the public under the conditions laid down by the decree of the Conseil d’Etat provided for in article L. 2223-18.

When, in the six months following this publicity, there is no successor to the concession holder, the mayor has the right to order, by decree and with the assent of the municipal council, that the land allocated to these concessions be taken back by the municipality.

Par dérogation aux dispositions de l’article L. 2223-17, à titre exceptionnel, lorsqu’une concession trentenaire, cinquantenaire, centenaire ou perpétuelle, accordée avant le 11 novembre 1918 à des personnes qui possèdent à la date du 22 janvier 1949 la nationalité allemande et ont quitté le territoire français, a cessé d’être entretenue, le maire peut constater cet état d’abandon par procès-verbal porté à la connaissance du public dans les conditions fixées par le décret en Conseil d’Etat prévu à l’article L. 2223-18.

Lorsque, dans les six mois qui suivent cette publicité, il ne se présente aucun ayant droit du concessionnaire, le maire a la faculté de prononcer, par arrêté et sur avis conforme du conseil municipal, la reprise par la commune des terrains affectés à ces concessions.
