Article L261-3 of the French Cinema and Moving Image Code

A financial penalty may be imposed by the Minister responsible for culture on the transferring producer in the event of failure to comply with the notification obligation set out in Article L. 261-1.


Before imposing a financial penalty, the Minister for Culture notifies the objections to the transferring producer, who has a period of fifteen working days in which to submit written observations.

The amount of the fine may not exceed 10% of the value of the works involved in the transaction.

Une sanction pécuniaire peut être prononcée par le ministre chargé de la culture à l’encontre du producteur cédant, en cas de manquement à l’obligation de notification prévue à l’article L. 261-1.


Avant de prononcer une sanction pécuniaire, le ministre chargé de la culture notifie les griefs au producteur cédant, qui dispose d’un délai de quinze jours ouvrés pour transmettre ses observations écrites.


Le montant de la sanction pécuniaire s’élève au maximum à 10 % de la valeur des œuvres faisant l’objet de l’opération.
