The Autorité de contrôle prudentiel et de résolution shall examine and evaluate the strategies, processes and reporting procedures established by the undertakings referred to in Article L. 310-3-1 in order to comply with the provisions of Title V of this Book.
This examination and evaluation shall include an assessment of the qualitative requirements relating to the system of governance, an assessment of the risks to which the undertakings concerned are exposed or could be exposed and an assessment of their ability to measure these risks in the light of the environment in which they operate.
The AMF shall examine and assess whether the undertakings concerned comply with the requirements of Title V of this Book relating in particular to the system of governance, technical provisions, capital requirements, investment rules, the quantity and quality of own funds and, where appropriate, full or partial internal models.
The AMF assesses the adequacy of the methods and practices implemented by the undertakings concerned with a view to detecting any hazards or changes in economic conditions that could have an adverse impact on the overall financial position of the undertaking concerned. It assesses the ability of the undertakings concerned to withstand such contingencies or changes in economic conditions.
The Authority shall determine the minimum frequency and scope of the examinations, assessments and evaluations referred to in the preceding paragraphs, taking into account the nature, scale and complexity of the activities of the undertakings concerned.
