I. – Sales and repurchases of goods carried out in premises or on sites not intended for public sale or repurchase of these goods and from vehicles specially equipped for this purpose are deemed to be unpacking sales.
Unpacking sales may not exceed two months per calendar year on the same premises, on the same site or in the same district. Unpacking sales of fresh fruit and vegetables during periods of economic crisis are not taken into account when calculating this limit. Unpacking sales are subject to prior declaration to the mayor of the commune on which the place of sale depends, a copy of which is sent at the same time to the administrative authority responsible for competition and consumer affairs in the département of the place of sale.
Individuals not entered in the trade and company register are authorised to take part in unpacking sales with a view to selling exclusively personal and used items no more than twice a year.
II. – The provisions of I are not applicable to professionals:
1° Carrying out, in one or more communes, sales rounds as defined by 1° of article L. 121-22 of the Consumer Code;
2° Carrying out sales defined by article L. 320-2 ;
3° Who provide proof of a road permission or parking permit for sales on the public highway.
III. – The provisions of I do not apply to organisers of :
1° Commercial events involving sales of goods to the public in an exhibition centre;
2° Commercial events classified as trade fairs not held in an exhibition centre;
3° Funfairs and agricultural events where only producers or breeders are exhibitors.
