Judicial reorganisation or liquidation proceedings instituted by the aforementioned law no. 85-98 of 25 January 1985 may only be opened in respect of a company mentioned in article L. 310-1 at the request of the Autorité de contrôle prudentiel et de résolution; the court may also initiate proceedings of its own motion or be requested to do so by the public prosecutor after receiving the assent of the Autorité de contrôle prudentiel et de résolution. The provisions of article L. 326-4 are applicable to receivership proceedings.
The President of the Court may only be seised of an application to open the amicable settlement instituted by Articles L. 611-3 to L. 611-6 of the Commercial Code in respect of an aforementioned company, after receiving the assent of the Autorité de contrôle prudentiel et de résolution.
When winding-up proceedings are opened against an undertaking mentioned in Article L. 310-1, the Autorité de contrôle prudentiel et de résolution shall immediately inform the competent authorities of the other Member States of the European Union.
When winding-up proceedings are opened against an undertaking referred to in Article L. 310-1, its authorisation is withdrawn in accordance with the procedures set out in Article L. 325-1. In this case, the provisions of articles L. 326-4, L. 326-9 and L. 326-14 shall apply. The company remains subject to the supervision of the Autorité de contrôle prudentiel et de résolution until all the liabilities arising from the contracts taken out by the company have been paid in full and definitively to the policyholders and third party beneficiaries or have been the subject of a transfer authorised under the conditions set out in article L. 324-1.
The liquidator may, with the agreement of the Autorité de contrôle prudentiel et de résolution, continue certain activities of the insurance undertaking concerned insofar as this is necessary and appropriate for the purposes of the liquidation.
