Article L311-26 of the French Insurance Code

Without prejudice to Articles L. 142-9, L. 612-17 and L. 632-1 A of the French Monetary and Financial Code, Articles L. 311-18, L. 311-58, L. 421-9-5 and L. 423-6 of this Code, Article L. 431-6 of the French Mutual Code and Article L. 931-40 of the French Social Security Code, all persons who have directly or indirectly contributed to the performance of the missions defined in 4° of II. 641-1 of the Monetary and Financial Code, all persons who have directly or indirectly contributed to the performance of the tasks defined in 4° of II of article L. 612-1 of the same code, including potential purchasers or beneficiaries.

This obligation does not apply when the authority or person who communicated the confidential information has given its express prior consent to its disclosure and solely for the purposes for which it gave its consent.

Article L311-26

Sans préjudice des articles L. 142-9, L. 612-17 et L. 632-1 A du code monétaire et financier, des articles L. 311-18, L. 311-58, L. 421-9-5 et L. 423-6 du présent code, de l’article L. 431-6 du code de la mutualité et de l’article L. 931-40 du code de la sécurité sociale, sont tenues au secret professionnel, dans les conditions et sous les peines prévues à l’article L. 641-1 du code monétaire et financier, toutes les personnes ayant directement ou indirectement contribué à l’exercice des missions définies au 4° du II de l’article L. 612-1 du même code, y compris les acquéreurs ou bénéficiaires potentiels.


Cette obligation ne s’applique pas lorsque l’autorité ou la personne qui a communiqué ces informations confidentielles a donné son consentement exprès et préalable à leur divulgation et aux seules fins pour lesquelles elle a donné son accord.
