Article L311-4 of the French Tourism Code

On the departure of the tenant or the transferee of the leasehold right, the premises are returned to the owner in the state in which they are, without the owner being able to demand that the premises be returned to their previous state.

If the renewal of the lease is refused, the amount of the eviction compensation provided for inarticle L. 145-14 of the French Commercial Code is set taking into account the increase in value of the business as a result of the work mentioned in article L. 311-1.

Lors du départ du locataire ou du cessionnaire du droit au bail, les lieux sont restitués au propriétaire dans l’état où ils se trouvent, sans que celui-ci puisse exiger la remise des lieux dans leur état antérieur.

En cas de refus de renouvellement du bail, le montant de l’indemnité d’éviction prévue par l’article L. 145-14 du code de commerce est fixé compte tenu de la plus-value apportée au fonds de commerce par l’exécution des travaux mentionnés à l’article L. 311-1.
