Article L311-6 of the French Insurance Code

The supervisory board examines individual and group preventive recovery plans after an adversarial procedure.

If the board considers that a plan has significant shortcomings, it notifies the person who submitted the plan of its decision and invites him to submit, within a period of two months, extendable by one month, an amended plan to remedy these shortcomings.

If the College considers that the plan submitted to it at the end of this period is still inadequate, it may require the person concerned to supplement it on the following points:

1° Reducing its risk profile, including liquidity risk;

2° Adopting rapid measures to recapitalise or improve coverage of prudential requirements;

3° Increasing its capacity to restore critical functions and activities representing a significant source of income or profits.

The supervisory college shall communicate to the resolution college the preventive recovery plans, as they result from its examination.

Le collège de supervision examine les plans préventifs de rétablissement individuels et de groupe, au terme d’une procédure contradictoire.


Si le collège estime qu’un plan présente des lacunes importantes, il notifie sa décision à la personne lui ayant soumis le plan et l’invite à lui soumettre, dans un délai de deux mois prorogeable d’un mois, un plan modifié permettant de remédier à ces lacunes.


Si le collège considère que le plan qui lui est soumis à l’issue de ce délai est toujours insuffisant, il peut enjoindre à la personne concernée de le compléter sur les points suivants :


1° La réduction de son profil de risque, y compris le risque de liquidité ;


2° L’adoption de mesures rapides de recapitalisation ou d’amélioration de la couverture des exigences prudentielles ;


3° L’accroissement de sa capacité de rétablissement des fonctions critiques et des activités représentant une source importante de revenus ou de bénéfices.


Le collège de supervision communique au collège de résolution les plans préventifs de rétablissement, tels qu’ils résultent de son examen.
