Health controls at borders are governed, within the territory of the French Republic, by the provisions of the health regulations adopted by the World Health Organisation in accordance with Articles 21 and 22 of its Constitution, international arrangements and national laws and regulations in force or to be adopted in this area with a view to preventing the spread of transmissible diseases by land, sea or air.
To carry out these checks, the representative of the State in the département may authorise the agents mentioned in articles L. 1421-1 and L. 1435-7 and the agents of the ministers responsible for agriculture, customs, border police, the sea and transport. Military entry points, military means of transport and means of transport specifically chartered by the military authority are controlled by agents authorised by the Minister of Defence.
To this end, these agents have the prerogatives mentioned in articles L. 1421-2 and L. 1421-3.
The representative of the State in the département may also authorise agents of entry point managers.
In addition, the State representative may entrust the performance of technical inspections and the issue of the corresponding certificates to approved persons or organisations.
