Article L3121-1 of the French Public procurement code

The concession-granting authority is free to organise an advertising and competitive tendering procedure leading to the selection of the concessionaire in compliance with the provisions of Chapters I to V of this Title and the procedural rules laid down by decree in the Conseil d’Etat.
It may have recourse to negotiation.
These provisions apply subject to the specific rules of Chapter VI of this Title.

Article L3121-1

L’autorité concédante organise librement une procédure de publicité et mise en concurrence qui conduit au choix du concessionnaire dans le respect des dispositions des chapitres I à V du présent titre et des règles de procédure fixées par décret en Conseil d’Etat.
Elle peut recourir à la négociation.
Ces dispositions s’appliquent sous réserve des règles particulières du chapitre VI du présent titre.
