Article L3122-3 of the French Public Health Code

The victim informs the Office of any legal proceedings that may be in progress. If legal action is taken, the victim informs the judge that the matter has been referred to the Office.

Victims only have the right to take legal action against the Office if their claim for compensation has been rejected, if no offer has been made to them within the period mentioned in article L. 3122-5 or if they have not accepted the offer made to them. This action is brought before the Paris Court of Appeal.

The victim’s acceptance of the Office’s offer constitutes a settlement within the meaning of article 2044 of the Civil Code.

The court’s decision in the legal action provided for in the second paragraph shall be deemed to constitute a waiver of any pending legal action and shall render inadmissible any other legal action seeking compensation for the same losses.

La victime informe l’office des procédures juridictionnelles éventuellement en cours. Si une action en justice est intentée, la victime informe le juge de la saisine de l’office.

La victime ne dispose du droit d’action en justice contre l’office que si sa demande d’indemnisation a été rejetée, si aucune offre ne lui a été présentée dans le délai mentionné à l’article L. 3122-5 ou si elle n’a pas accepté l’offre qui lui a été faite. Cette action est intentée devant la cour d’appel de Paris.

L’acceptation de l’offre de l’office par la victime vaut transaction au sens de l’article 2044 du code civil.

La décision juridictionnelle rendue dans l’action en justice prévue au deuxième alinéa vaut désistement de toute action juridictionnelle en cours et rend irrecevable toute autre action juridictionnelle visant à la réparation de mêmes préjudices.
