Article L3123-18 of the French Public procurement code

The concession-granting authority may not impose conditions on the participation of candidates in the award procedure other than those designed to ensure that they have the ability to carry out the professional activity, the economic and financial capacity or the technical and professional capability necessary to perform the concession contract.
Where the management of a public service is conceded, these conditions of participation may relate in particular to the ability of the candidates to ensure the continuity of the public service and the equality of users before the public service.
These conditions are linked and proportionate to the subject of the concession contract or to its conditions of performance.

L’autorité concédante ne peut imposer aux candidats des conditions de participation à la procédure de passation autres que celles propres à garantir qu’ils disposent de l’aptitude à exercer l’activité professionnelle, de la capacité économique et financière ou des capacités techniques et professionnelles nécessaires à l’exécution du contrat de concession.
Lorsque la gestion d’un service public est concédée, ces conditions de participation peuvent notamment porter sur l’aptitude des candidats à assurer la continuité du service public et l’égalité des usagers devant le service public.
Ces conditions sont liées et proportionnées à l’objet du contrat de concession ou à ses conditions d’exécution.
