Article L3123-6 of the French Public procurement code

The conceding authority may, by way of exception, authorise an economic operator who would be in a case of exclusion provided for in sub-sections 1 and 3 of this section, to participate in the procedure for the award of a concession contract, provided that this is justified by overriding reasons of general interest, that the concession contract in question can only be awarded to this economic operator and that a final judgment of a court of a Member State of the European Union does not expressly exclude the operator concerned from concession contracts.

Article L3123-6

L’autorité concédante peut, à titre exceptionnel, autoriser un opérateur économique qui serait dans un cas d’exclusion prévu aux sous-sections 1 et 3 de la présente section, à participer à la procédure de passation d’un contrat de concession, à condition que cela soit justifié par des raisons impérieuses d’intérêt général, que le contrat de concession en cause ne puisse être confié qu’à ce seul opérateur économique et qu’un jugement définitif d’une juridiction d’un Etat membre de l’Union européenne n’exclut pas expressément l’opérateur concerné des contrats de concession.
