On the occasion of the general renewal of the departmental council, any departmental council president or any vice-president delegated by the latter who, in order to carry out his or her mandate, had ceased to carry out his or her professional activity shall receive, at his or her request, a differential end-of-mandate allowance if he or she finds himself or herself in one of the following situations:
– being registered with the institution mentioned in l’article L. 5312-1 of the Labour Code in accordance with the provisions of article L. 5411-1 of the same code;
– have resumed a professional activity providing them with an income lower than the office allowances they received for their last elective office.
The monthly amount of the allowance is at most equal to 80% of the difference between the amount of the gross monthly allowance the person concerned received for the performance of their duties, within the limit of the maximum rates set in article L. 3123-17, and all the resources he or she receives at the end of the term of office.
The allowance is paid for a period of one year at most. It cannot be combined with those provided for under articles L. 2123-11-2 and L. 4135-9-2. From the seventh month following the start of payment of the allowance, the rate mentioned in the fourth paragraph is at most equal to 40%.
The financing of this allowance is provided under the conditions laid down by Article L. 1621-2.
The terms and conditions for the application of this article are determined by decree in the Conseil d’Etat.
