Article L3124-6 of the French Public procurement code

Defence or security concessions excluded or exempted from the Agreement on Government Procurement or another equivalent international agreement to which the European Union is a party shall be awarded to economic operators from Member States of the European Union.
The awarding authorities may, however, authorise, on a case-by-case basis, economic operators from countries outside the European Union to take part in an award procedure.
The decision of the awarding authority shall take into account in particular the imperatives of security of information and supply, the preservation of the interests of defence and State security, the interest of developing the European defence technological and industrial base, the objectives of sustainable development, the attainment of mutual benefits and the requirements of reciprocity.

Article L3124-6

Les concessions de défense ou de sécurité, exclues ou exemptées de l’accord sur les marchés publics ou d’un autre accord international équivalent auquel l’Union européenne est partie, sont passées avec des opérateurs économiques d’Etats membres de l’Union européenne.
Les autorités concédantes peuvent toutefois autoriser, au cas par cas, les opérateurs économiques de pays tiers à l’Union européenne à participer à une procédure de passation.
La décision de l’autorité concédante prend notamment en compte les impératifs de sécurité de l’information et d’approvisionnement, la préservation des intérêts de la défense et de la sécurité de l’Etat, l’intérêt de développer la base industrielle et technologique de défense européenne, les objectifs de développement durable, l’obtention d’avantages mutuels et les exigences de réciprocité.
