Article L313-30 of the French Monetary and Financial Code

A credit institution or finance company that assigns or pledges business receivables under the conditions set out in article L. 313-23 may, at any time, issue securities intended for the use of all or part of the loans granted.

Successive holders of these securities benefit from the rights listed in articles L. 313-31 to L. 313-33 on condition that the forms have been made available to the organisation providing the financing in accordance with the agreements between the latter and the lending institution.

L’établissement de crédit ou la société de financement cessionnaire ou nanti de créances professionnelles dans les conditions prévues à l’article L. 313-23 peut, à tout moment, émettre des titres destinés à la mobilisation de tout ou partie des crédits consentis.

Les porteurs successifs de ces titres bénéficient des droits énumérés aux articles L. 313-31 à L. 313-33 sous la condition que les bordereaux aient été mis à la disposition de l’organisme qui assure le financement conformément aux conventions intervenues entre celui-ci et l’établissement prêteur.
