Article L313-62 of the French Consumer Code

In the case of a lease with a promise to sell, the deed recording the exercise of the option is concluded under the condition precedent provided for in article L. 313-41.
When this condition is not met, the lessor returns all sums paid by the lessee, with the exception of rent and the costs of restoring the property.

En cas de location assortie d’une promesse de vente, l’acte constatant la levée de l’option est conclu sous la condition suspensive prévue à l’article L. 313-41.
Lorsque cette condition n’est pas réalisée, le bailleur restitue toutes sommes versées par le preneur à l’exception des loyers et des frais de remise en état du bien.
