The works concession contract or the contract granting a public service concession may also include an option for the assets belonging to the concessionaire that are not required for the operation of the public service to be taken back by the granting public entity at the end of the contract, in return for a price agreed between the parties or, where applicable, free of charge.

Article L3132-6

Le contrat de concession de travaux ou le contrat concédant un service public peut également prévoir une faculté de reprise au profit de la personne publique concédante au terme du contrat, moyennant un prix convenu entre les parties ou, le cas échéant, gratuitement, des biens appartenant au concessionnaire qui ne sont pas nécessaires au fonctionnement du service public.
