Late payment shall give rise, under the conditions set out in this sub-section, to interest on arrears, a fixed indemnity and, where applicable, additional compensation paid to the creditor by the contracting authority.
From the day following the expiry of the payment period or the due date set out in the concession contract, late payment shall give rise, ipso jure and without further formality, to interest on arrears, the rate of which shall be set by regulation.
It also gives rise, ipso jure and without further formality, to the payment of a fixed indemnity for recovery costs, the amount of which is set by regulation.
When the recovery costs incurred exceed the amount of the fixed indemnity provided for in the previous paragraph, the creditor may request additional compensation, on justification.

Article L3133-13

Le retard de paiement ouvre droit, dans les conditions prévues à la présente sous-section, à des intérêts moratoires, à une indemnité forfaitaire et, le cas échéant, à une indemnisation complémentaire versés au créancier par le pouvoir adjudicateur.
Dès le lendemain de l’expiration du délai de paiement ou de l’échéance prévue par le contrat de concession, le retard de paiement fait courir, de plein droit et sans autre formalité, des intérêts moratoires dont le taux est fixé par voie réglementaire.
Il donne lieu, de plein droit et sans autre formalité, au versement d’une indemnité forfaitaire pour frais de recouvrement, dont le montant est fixé par voie réglementaire.
Lorsque les frais de recouvrement exposés sont supérieurs au montant de l’indemnité forfaitaire prévue à l’alinéa précédent, le créancier peut demander une indemnisation complémentaire, sur justification.
