Article L3134-2 of the French Public procurement code

When a third party against whom grounds for exclusion exist is presented by the concessionaire at the stage of execution of the concession contract, the conceding authority requires his replacement by a third party who is not the subject of grounds for exclusion under the conditions laid down by regulation.

Lorsqu’un tiers à l’encontre duquel il existe un motif d’exclusion est présenté par le concessionnaire au stade de l’exécution du contrat de concession, l’autorité concédante exige son remplacement par un tiers qui ne fait pas l’objet d’un motif d’exclusion dans les conditions prévues par voie réglementaire.
