Article L3134-6 of the French Labour Code

Derogations from the provisions of article L. 3134-3 may be granted by regulation for specific categories of activity, in particular for businesses where work is carried out which, by its nature, cannot be interrupted or postponed, as well as for activities which, by their nature, are limited to certain periods of the year or are subject to unusually intense activity at certain times of the year.

The work authorised on Sundays and public holidays in these businesses and the conditions under which it is authorised are determined in a uniform manner for all businesses in the same category, taking into account the provisions of the seventh paragraph of article L. 3134-5.

Article L3134-6

Des dérogations aux dispositions de l’article L. 3134-3 peuvent être accordées par voie réglementaire pour des catégories d’activités déterminées, notamment pour des exploitations où sont accomplis des travaux qui, par nature, ne peuvent être interrompus ou ajournés, ainsi que pour les activités qui, par nature, sont limitées à certaines périodes de l’année ou sont soumises à une activité d’une intensité inhabituelle à certaines périodes de l’année.

La détermination des travaux autorisés les dimanches et jours fériés dans ces exploitations et les conditions dans lesquelles ils sont autorisés intervient de manière uniforme pour toutes les exploitations de même catégorie et en tenant compte des dispositions du septième alinéa de l’article L. 3134-5.
