Failure to comply with the measures prescribed by the requesting authority under articles L. 3131-8 and L. 3131-9 is punishable by six months’ imprisonment and a fine of €10,000.
Violation of quarantine measures and measures to place and keep in isolation ordered on the basis of 2° of I of article L. 3131-1 is punishable by a fifth-class fine. This offence may be subject to the fixed fine procedure provided for inarticle 529 of the Code of Criminal Procedure.
If the violations referred to in the second paragraph of this article are recorded more than three times within a period of thirty days, the offence will be punishable by six months’ imprisonment and a fine of €3,750, as well as the additional penalty of community service, in accordance with the terms ofarticle 131-8 of the Criminal Code and under the conditions set out in articles 131-22 to 131-24 of the same code, and the additional penalty of suspension of the driving licence for a maximum of three years if the offence was committed using a vehicle.
The officers referred to in article 20 and in 1°, 1° bis and 1° ter of article 21 of the Code of Criminal Procedure and customs officers may draw up official reports of the offences referred to in the second paragraph of this article when they do not require any investigative action on their part.
The officers referred to in articles L. 511-1, L. 521-1, L. 531-1 and L. 532-1 of the Code de la sécurité intérieure (Internal Security Code) may draw up official reports of the offences provided for in the second paragraph of this article when they are committed respectively on municipal territory, on territory for which they are sworn or on the territory of the City of Paris and when they do not require any investigative action on their part.
The application of criminal sanctions does not prevent the administrative authority from automatically taking the measures prescribed under article L. 3131-1 of this code.
