In the absence of a stipulation in the agreement concluded in application of article L. 3141-22 :
1° The continuous fraction of at least twelve working days is allocated during the period from 1st May to 31st October of each year;
2° The fractioning of leave beyond the twelfth day is carried out under the following conditions:
a) Days remaining due in application of the second paragraph of article L. 3141-19 may be granted in one or more instalments outside the period from 1st May to 31st October each year;
b) Two additional working days of leave are granted when the number of days of leave taken outside this period is at least equal to six and only one when this number is between three and five days. The days of main leave due in excess of twenty-four working days are not taken into account for the purposes of entitlement to this additional leave.
This article may be waived with the individual agreement of the employee.
