Article L3141-5 of the French Labour Code

The following are considered to be periods of actual work for the purpose of determining the length of leave:

1° periods of paid leave ;

2° Periods of maternity leave, paternity leave, childcare leave and adoption leave;

3° Compulsory compensatory leave in the form of rest provided for in articles L. 3121-30, L. 3121-33 and L. 3121-38 ;

4° Rest days granted under the collective agreement concluded in application of article L. 3121-44;

5° Periods, up to a maximum uninterrupted period of one year, during which performance of the employment contract is suspended due to an accident at work or occupational illness;

6° Periods during which an employee is retained or called up for national service in any capacity whatsoever.

Article L3141-5

Sont considérées comme périodes de travail effectif pour la détermination de la durée du congé :

1° Les périodes de congé payé ;

2° Les périodes de congé de maternité, de paternité et d’accueil de l’enfant et d’adoption ;

3° Les contreparties obligatoires sous forme de repos prévues aux articles L. 3121-30, L. 3121-33 et L. 3121-38 ;

4° Les jours de repos accordés au titre de l’accord collectif conclu en application de l’article L. 3121-44 ;

5° Les périodes, dans la limite d’une durée ininterrompue d’un an, pendant lesquelles l’exécution du contrat de travail est suspendue pour cause d’accident du travail ou de maladie professionnelle ;

6° Les périodes pendant lesquelles un salarié se trouve maintenu ou rappelé au service national à un titre quelconque.
