Article L3142-105 of the French Labour Code

An employee who sets up or takes over a business is entitled, subject to a condition of seniority in the company and under the conditions laid down in this section :

1° Either to leave ;

2° or to a period of part-time work.

Seniority acquired in any other company of the same group, within the meaning of article L. 2331-1, is taken into account as seniority in the company.

Article L3142-105

Le salarié qui crée ou reprend une entreprise a droit, sous réserve d’une condition d’ancienneté dans l’entreprise et dans les conditions fixées à la présente section :

1° Soit à un congé ;

2° Soit à une période de travail à temps partiel.

L’ancienneté acquise dans toute autre entreprise du même groupe, au sens de l’article L. 2331-1, est prise en compte au titre de l’ancienneté dans l’entreprise.
