Article L3142-128 of the French Labour Code

In companies with fewer than three hundred employees, the employer may defer the employee’s leave or the start of the period of part-time work if exercising this right would result in the number of hours of leave requested being excessive in relation to the total number of hours worked in the year.

However, the number of hours of leave to which an employee is entitled may, at the employee’s request, be carried over from one year to the next, provided that the total number of hours carried over does not exceed four years.

Dans les entreprises de moins de trois cents salariés, l’employeur peut différer le départ en congé ou le début de la période de travail à temps partiel du salarié lorsque l’exercice de ce droit aurait pour effet de porter le nombre d’heures de congé demandées à un niveau excessif au regard du nombre total d’heures travaillées dans l’année.


Toutefois, le nombre d’heures de congé auquel un salarié a droit peut être, à sa demande, reporté d’une année sur l’autre, sans que le cumul des reports puisse dépasser quatre ans.
