Article L3153-1 of the French Labour Code

In the absence of a collective agreement as referred to in Article L. 3152-3, a guarantee system is set up by decree.

Pending the implementation of a guarantee scheme, when the acquired rights, converted into monetary units, exceed the ceiling mentioned in article L. 3152-3, an indemnity corresponding to the monetary conversion of all the rights is paid to the employee.

Article L3153-1

A défaut de convention ou d’accord collectif mentionné à l’article L. 3152-3, un dispositif de garantie est mis en place par décret.

Dans l’attente de la mise en place d’un dispositif de garantie, lorsque les droits acquis, convertis en unités monétaires, excèdent le plafond mentionné à l’article L. 3152-3, une indemnité correspondant à la conversion monétaire de l’ensemble des droits est versée au salarié.
