Article L321-17 of the French Commercial code

The operators of voluntary sales of furniture by public auction mentioned in Article L. 321-4 and the public or ministerial officers competent to carry out judicial and voluntary sales, as well as the experts who assist them in the description, presentation and valuation of goods, incur liability during or on the occasion of auctions and sales of furniture by public auction, in accordance with the rules applicable to such sales.

Clauses intended to exclude or limit their liability are prohibited and deemed unwritten.

Civil liability actions brought in connection with auctions and voluntary and judicial sales of furniture by public auction are time-barred after five years from the auction or the auction. Mention of this limitation period must be made in the advertising provided for in article L. 321-11.

Article L321-17

Les opérateurs de ventes volontaires de meubles aux enchères publiques mentionnés à l’article L. 321-4 et les officiers publics ou ministériels compétents pour procéder aux ventes judiciaires et volontaires ainsi que les experts qui les assistent dans la description, la présentation et l’estimation des biens engagent leur responsabilité au cours ou à l’occasion des prisées et des ventes de meubles aux enchères publiques, conformément aux règles applicables à ces ventes.

Les clauses qui visent à écarter ou à limiter leur responsabilité sont interdites et réputées non écrites.

Les actions en responsabilité civile engagées à l’occasion des prisées et des ventes volontaires et judiciaires de meuble aux enchères publiques se prescrivent par cinq ans à compter de l’adjudication ou de la prisée. Mention de ce délai de prescription doit être rappelée dans la publicité prévue à l’article L. 321-11.
