A regulatory authority known as the “Conseil des maisons de vente” is hereby established.
The Conseil des maisons de vente, a public utility establishment with legal personality, is responsible for:
1° Observing the economy of the public auction sector;
2° Determining and disseminating good professional practices and formulating recommendations with regard to voluntary sales of furniture by public auction;
3° Supporting and promoting the quality and safety of voluntary sales of furniture by public auction through actions meeting the collective interest of the profession;
4° Informing, on the one hand, professionals engaged in the activity of voluntary sales of furniture by public auction and, on the other hand, the public about the applicable regulations;
5° Ensuring the organisation of training with a view to obtaining the qualification required to manage voluntary sales of furniture by public auction;
6° Recording the declarations of the persons mentioned in I and II of Article L. 321-4 and drawing up, updating and publishing a national directory of the said persons;
7° Registering the declarations of nationals of the States mentioned in section 2 of this chapter;
8° Collaborating with the competent authorities of the other Member States of the European Union or parties to the Agreement on the European Economic Area in order to facilitate the application of Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications;
9° Drawing up a compendium of ethical obligations applicable to the persons mentioned in Article L. 321-4 of this Code, submitted to the Minister of Justice for approval and made public;
10° Determining the procedures for completing the continuing professional training provided for in Article L. 321-4-1 ;
11° Preventing or conciliating any professional disputes between the persons mentioned in I and II of article L. 321-4;
12° Examining complaints made against the same persons in connection with the exercise of their profession;
13° Sanctioning, under the conditions provided for in Article L. 321-23-2, breaches of the laws, regulations and professional obligations applicable to the persons mentioned in I and II of Article L. 321-4 and persons authorised to manage sales pursuant to the first paragraph of article L. 321-9.
The Conseil des maisons de vente may also formulate proposals for legislative and regulatory amendments concerning the activity of voluntary sale of furniture by public auction.
