Concession contracts concluded by a contracting authority, including one acting as a contracting entity, which does not exercise control over a legal person under the conditions laid down in Article L. 3211-1, when the following conditions are met:
1° The contracting authority exercises over the legal person concerned, jointly with other contracting authorities, including when they are acting as a contracting entity, a control similar to that which they exercise over their own departments;
2° The legal person carries out more than 80% of its activity within the framework of tasks entrusted to it by the contracting authorities which control it or by other legal persons controlled by the same contracting authorities;
3° The controlled legal person does not have a direct private capital holding, with the exception of those forms of private capital holding without the capacity to control or block required by law which do not enable a decisive influence to be exercised over the controlled legal person.
