Article L3212-2 of the French Public Health Code

Before admitting a person for psychiatric care in application of article L. 3212-1, the director of the receiving establishment checks the person’s identity. When the person is admitted in application of 1° of II of the same article L. 3212-1, the director of the establishment also checks that the request for care has been drawn up in accordance with the same 1° and ascertains the identity of the person making the request for care. If the request is made on behalf of an adult protected by the person in charge of a legal protection measure, the latter must provide the future protection mandate endorsed by the court clerk or an extract from the judgment instituting the protection measure in support of the request.

Avant d’admettre une personne en soins psychiatriques en application de l’article L. 3212-1, le directeur de l’établissement d’accueil s’assure de son identité. Lorsque la personne est admise en application du 1° du II du même article L. 3212-1, le directeur de l’établissement vérifie également que la demande de soins a été établie conformément au même 1° et s’assure de l’identité de la personne qui formule la demande de soins. Si la demande est formulée pour un majeur protégé par la personne chargée d’une mesure de protection juridique à la personne, celle-ci doit fournir à l’appui de sa demande le mandat de protection future visé par le greffier ou un extrait du jugement instaurant la mesure de protection.
