The Autorité de contrôle prudentiel et de résolution shall inform the European Commission, the European Insurance and Occupational Pensions Authority and the supervisory authorities of the other Member States of any acquisition of a holding which may confer control of an undertaking referred to in 1° of Article L. 310-2 or in 1° of III of Article L. 310-1-1 on an undertaking whose registered office is located in a State which is not a party to the Agreement on the European Economic Area. Control is defined in articles L. 233-3 and L. 233-16 of the French Commercial Code.
At the request of the competent authority of the European Communities, in the circumstances referred to in the second paragraph of Article L. 321-2, the Autorité de contrôle prudentiel et de résolution shall oppose, for a period of three months, any acquisition of a holding which would have the consequences referred to in the previous paragraph. The three-month period may be extended by decision of the Conseil des Communautés.
The provisions of the preceding paragraph do not apply to the acquisition of shareholdings likely to confer control of an insurance undertaking mentioned in Article L. 310-1 on an undertaking already established in the territory of a State party to the Treaty on the European Economic Area.
