Article L3221-11-1 of the French General Code of Local Authorities

Where article L. 3221-11, the decision of the Departmental Council or the Permanent Commission instructing the Chairman of the Departmental Council to sign a specific contract or framework agreement may be taken before the award procedure for this contract or framework agreement is initiated. In this case, it must include a definition of the scope of the need to be met and the estimated value of the contract or framework agreement.

Article L3221-11-1

Lorsqu’il n’est pas fait application de l’article L. 3221-11, la délibération du conseil départemental ou de la commission permanente chargeant le président du conseil départemental de souscrire un marché ou un accord-cadre déterminé peut être prise avant l’engagement de la procédure de passation de ce marché ou de cet accord-cadre. Elle comporte alors obligatoirement la définition de l’étendue du besoin à satisfaire et le montant prévisionnel du marché ou de l’accord-cadre.
