Article L3221-11 of the French General Code of Local Authorities

The president, by delegation of the departmental council , may be entrusted, for the duration of his mandate, with taking any decision concerning the preparation, award, performance and settlement of contracts and framework agreements, as well as any decision concerning their amendments, when the appropriations are entered in the budget.

The president of the departmental council reports on the exercise of this competence at the next useful meeting of the departmental council and informs the permanent committee.

Article L3221-11

Le président, par délégation du conseil départemental , peut être chargé, pour la durée de son mandat, de prendre toute décision concernant la préparation, la passation, l’exécution et le règlement des marchés et des accords-cadres, ainsi que toute décision concernant leurs avenants, lorsque les crédits sont inscrits au budget.

Le président du conseil départemental rend compte à la plus proche réunion utile du conseil départemental de l’exercice de cette compétence et en informe la commission permanente.
