Article L3221-10-1 of the French General Code of Local Authorities

The president of the departmental council brings actions on behalf of the department by virtue of the decision of the departmental council and may, with the assent of the permanent committee, defend any action brought against the department.

He may, by delegation of the departmental council, be charged for the duration of his mandate with instituting legal proceedings in the name of the department or defending the department in proceedings brought against it, in cases defined by the departmental council. He reports to the next meeting of the departmental council on the exercise of this competence.

Le président du conseil départemental intente les actions au nom du département en vertu de la décision du conseil départemental et il peut, sur l’avis conforme de la commission permanente, défendre à toute action intentée contre le département.

Il peut, par délégation du conseil départemental , être chargé pour la durée de son mandat d’intenter au nom du département les actions en justice ou de défendre le département dans les actions intentées contre lui, dans les cas définis par le conseil départemental . Il rend compte à la plus proche réunion du conseil départemental de l’exercice de cette compétence.
