The added sugar content of everyday consumer foodstuffs intended for the final consumer distributed in the collectivities mentioned in Article 73 of the Constitution and in the collectivities of Saint-Barthélemy, Saint-Martin and Saint-Pierre-et-Miquelon, but not distributed by the same retailers in mainland France, may not exceed the highest added sugar content found in the most widely distributed assimilable foodstuffs of the same family in mainland France.
An order by the Ministers of Health, Agriculture, Consumer Affairs and Overseas Territories determines the list of foodstuffs subject to the provisions of the first paragraph.
When the highest added sugar content mentioned in the first paragraph decreases within a family of foodstuffs distributed in mainland France, those responsible for marketing assimilable foodstuffs of the same family distributed overseas subject to the provisions of the same first paragraph are authorised to continue marketing them until stocks are exhausted and within a maximum period of six months.
