Article L326-4 of the French Insurance Code

In the event of the opening of compulsory liquidation proceedings in respect of an insurance undertaking, policyholders, subscribers and beneficiaries of insurance contracts and the guarantee fund referred to in Article L. 423-1 are, without prejudice to Article L. 113-2 or to contractual obligations, exempt from the declaration provided for in Article L. 622-24 of the Commercial Code. A decree of the Conseil d’Etat shall lay down the conditions for the application of this article.

En cas d’ouverture d’une procédure de liquidation judiciaire à l’égard d’une entreprise d’assurance, les assurés, souscripteurs, adhérents et bénéficiaires de contrats d’assurance ainsi que le fonds de garantie mentionné à l’article L. 423-1 sont, sans préjudice de l’article L. 113-2 ni des obligations contractuelles, dispensés de la déclaration prévue à l’article L. 622-24 du code de commerce. Un décret en Conseil d’Etat fixe les conditions d’application du présent article.
