Article L327-5 of the French Insurance Code

Where a French company has set up guarantees in a foreign country for the benefit of creditors whose rights derive from insurance contracts performed in that country, the preferential right instituted in the first paragraph of article L. 327-2 may not have the effect of placing these creditors in a more favourable situation than that of creditors whose rights derive from contracts performed on the territory of the French Republic.

Lorsqu’une entreprise française a constitué dans un pays étranger des garanties au profit de créanciers tenant leurs droits de contrats d’assurance exécutés dans ce pays, le privilège institué au premier alinéa de l’article L. 327-2 ne peut avoir pour effet de placer ces créanciers dans une situation plus favorable que celle des créanciers tenant leurs droits de contrats exécutés sur le territoire de la République française.
