Any person declaring the opening, transfer or relocation of a third or fourth category on-trade drinks outlet or any person declaring an establishment with a “petite licence restaurant” or “licence restaurant” must undergo specific training on the rights and obligations associated with operating a drinks outlet or an establishment with a “petite licence restaurant” or “licence restaurant”.
All persons referred to in article L. 3331-4 must undergo specific training on the rights and obligations relating to the takeaway sale of alcoholic beverages between 10pm and 8am.
On completion of this training, the persons referred to in the previous paragraph must have knowledge of the provisions of this Code relating to the prevention and combating of alcoholism, the protection of minors and the repression of public drunkenness, as well as legislation on drugs, the resale of tobacco, noise abatement, events likely to result in administrative closure, the general principles of the civil and criminal liability of natural persons and legal entities and the fight against discrimination.
However, for the persons mentioned in article L. 324-4 of the Tourism Code, the training provided for in this article is adapted to the specific conditions of the activity of these persons.
Any training organisation established on national territory which provides the training referred to in the previous paragraphs must be approved by order of the administrative authority.
Training bodies legally established in another Member State of the European Community or in another State party to the Agreement on the European Economic Area wishing to provide these training courses on a temporary and occasional basis on national territory are presumed to have this approval if the training programme they provide complies with this article.
This training is compulsory.
It leads to the issue of an operating licence valid for ten years. At the end of this period, attendance at a refresher course will extend the validity of the operating licence for a further ten years.
The procedures for applying this article shall be laid down by decree in the Conseil d’Etat.
