Article L3332-6 of the French Public Health Code

The sale of alcoholic beverages without having made the declaration required by articles L. 3332-3 or L. 3332-4-1, or the possession or sale of beverages from a group that does not correspond to the category of premises for which the declaration was made, is considered to be the opening of a new public house.

Est considéré comme ouverture d’un nouveau débit de boissons, le fait de vendre des boissons alcooliques sans avoir effectué la déclaration prescrite par les articles L. 3332-3 ou L. 3332-4-1, ou la détention ou la vente des boissons d’un groupe ne correspondant pas à la catégorie de débit pour laquelle la déclaration a été faite.
