Article L3332-8 of the French Public Health Code

When a building in which a public house is located has been demolished or converted to a new use as a result of expropriation in the public interest, or when the building has been demolished by the owner, the public house may be relocated to any point within the same municipality, subject to protected areas, i.e. :

1° In an existing building, at the latest within twelve months of the closure, which must be specially declared to the town hall of the commune in the départements and to the Préfecture de Police in Paris ;

2° In a new building, within three months of the reconstruction of this building, and at the latest within two years of the closure declared as above.

Article L3332-8

Lorsqu’un immeuble où est installé un débit de boissons a été supprimé ou affecté à une destination nouvelle, à la suite d’une expropriation pour cause d’utilité publique, ou lorsque cet immeuble a été démoli par le propriétaire, il peut être transféré sur n’importe quel point du territoire de la même commune, sous réserve des zones protégées, à savoir :

1° Dans un immeuble déjà existant, au plus tard dans les douze mois de la fermeture qui doit être spécialement déclarée à la mairie de la commune dans les départements et à la préfecture de police à Paris ;

2° Dans un immeuble nouveau, dans les trois mois de la reconstruction de cet immeuble, et au plus tard dans les deux ans de la fermeture déclarée comme il vient d’être dit.
