Article L3333-1 of the French Public Health Code

A 3rd and 4th category public house that has ceased to exist for more than five years is deemed to have been closed down and may no longer be transferred.

However, in the event of compulsory liquidation, the five-year period is extended, where applicable, until the close of business.

Similarly, the five-year period is suspended for the duration of a provisional closure ordered by the judicial or administrative authorities.

When a court decision has ordered the definitive closure of a public house, the establishment’s licence is cancelled.

Article L3333-1
