Article L3345-2 of the French Labour Code

The bodies mentioned in articles L. 213-1 or L. 752-4 of the Social Security Code or inarticle L. 723-3 of the Rural and Maritime Fishing Code have a period of time, set by decree, from the date of filing with the administrative authority of the agreements mentioned in articles L. 3313-3 and L. 3323-4 of this Code and the regulations of the savings plans mentioned in articles L. 3332-9, L. 3333-2, L. 3334-2 and L. 3334-4 of this Code and articles L. 224-14 and L. 224-16 of the Monetary and Financial Code, to request the withdrawal or amendment of clauses which are contrary to legal provisions, with the exception of rules relating to the procedures for terminating and revising agreements.

The period referred to in the first paragraph of this article may not exceed three months.

Article L3345-2

Les organismes mentionnés aux articles L. 213-1 ou L. 752-4 du code de la sécurité sociale ou à l’article L. 723-3 du code rural et de la pêche maritime disposent d’un délai, fixé par décret, à compter du dépôt auprès de l’autorité administrative des accords mentionnés aux articles L. 3313-3 et L. 3323-4 du présent code et des règlements des plans d’épargne mentionnés aux articles L. 3332-9, L. 3333-2, L. 3334-2 et L. 3334-4 du présent code et aux articles L. 224-14 et L. 224-16 du code monétaire et financier, pour demander le retrait ou la modification des clauses contraires aux dispositions légales, à l’exception des règles relatives aux modalités de dénonciation et de révision des accords.

Le délai mentionné au premier alinéa du présent article ne peut excéder trois mois.
