Article L336-1 of the French Insurance Code

At the end of each financial year, the Board of Directors or the Management Board draws up a written solvency report. This report sets out the conditions under which the company guarantees its commitments to policyholders or reinsured companies by building up sufficient technical provisions, the calculation methods and assumptions used for which are explained and justified. It also sets out the investment guidelines defined, presents and analyses the results obtained and indicates whether the solvency margin has been built up in accordance with the applicable regulations. The solvency report must contain an analysis of the conditions under which the undertaking is able, in the medium and long term, to meet all its commitments.

The solvency report referred to in the first paragraph is communicated to the statutory auditors and to the Autorité de contrôle prudentiel et de résolution.

A la clôture de chaque exercice, le conseil d’administration ou le directoire établit un rapport de solvabilité écrit. Ce rapport expose les conditions dans lesquelles l’entreprise garantit, par la constitution des provisions techniques suffisantes, dont les modalités de calcul et les hypothèses retenues sont explicitées et justifiées, les engagements qu’elle prend à l’égard des assurés ou des entreprises réassurées, rappelle les orientations définies en matière de placements, présente et analyse les résultats obtenus et indique si la marge de solvabilité est constituée conformément à la réglementation applicable. Le rapport de solvabilité contient obligatoirement une analyse des conditions dans lesquelles l’entreprise est en mesure, à moyen et long terme, de faire face à l’ensemble de ses engagements.

Le rapport de solvabilité mentionné au premier alinéa est communiqué aux commissaires aux comptes et à l’Autorité de contrôle prudentiel et de résolution.
