Harm reduction support centres for drug users are covered by article L. 312-1, paragraph 9 of the French Code de l’action sociale et des familles (Social Action and Family Code) and, along with other facilities, contribute to the policy of harm reduction. Their missions are defined by decree in the Conseil d’Etat.
By way of derogation from article L. 4211-1, those working in harm reduction support centres for drug users may dispense medicines that strictly correspond to their harm reduction mission, the list of which is set by order of the Minister for Health. A decree specifies the application of this paragraph.
The costs incurred by the centres mentioned in this article are covered by the health insurance system, without prejudice to other contributions, particularly from local authorities. The provisions of the Social Security Code and the Rural and Maritime Fishing Code relating to entitlement to benefits covered by the basic schemes, to reimbursement of the portion guaranteed by the health insurance scheme, to the insured person’s contribution to the tariffs used as a basis for reimbursement, and to the lump sum referred to in article L. 174-4 of the Social Security Code, are not applied to the financing of these expenses.
Risk and harm reduction activities are carried out in accordance with the guidelines set out in a national reference document approved by decree.
